Business, Estate, Trust Names

 

Rules for Use

 

·        If the party is the estate or trust, follow these instructions. However, if the party is a person that is the Executor or Trustee of an Estate or Trust, refer instead to the Person Names instructions when entering your party.

·        When a name begins with an A, An or The, these words should be included after the party name, separated by a comma (e.g.. Celotex Corporation, The).

 

Instructions

 

1.      Identify the party name on the document: Enter the party name in the last name field.

2.      Identify any additional descriptors that may be included with the party name: Either add it as an alias (e.g. a/k/a John Smith, d/b/a John’s Tree Service) or enter it in the party text field. (e.g. a corporation, a limited liability company, etc.), or both when necessary to clarify the complete party name.

 

a.      If the additional descriptors include any of the following names, you will need to add the names as alias(es) to the party (e.g. d/b/a, f/k/a, etc.)

 

·        a person’s name

·        business name   

·        another trust or estate name

 

b.      If the alias name contains a descriptor, you will enter the name as an alias and add the alias name to the party text field with its descriptor information.

c.      Enter any remaining additional descriptors in the party text field.

Miller Act cases

 

Rules for Use

 

·        Miller Act Cases, filed under cause of action 40:270 (Miller Act) and nature of suit (130:Miller Act), will have two plaintiffs, a plaintiff and a relator plantiff.

·        When a name begins with an A, An or The, these words should be included after the party name, separated by a comma (e.g. Celotex Corporation, The).

Person Names

 

Rules for Use

 

·        No punctuation should be used when adding a person’s name. Exception: A name that contains an apostrophe or hyphen should include the apostrophe or hyphen.

·        If the name is initials only, please add the initials in the last name field only without spaces.       

 

Instructions

 

1.      Identify the party name on the document: Enter the party name using the last name, first name, middle name and the generation field, if necessary. Examples of how to enter certain types of person names can be found at the links below.  Note: Do not use the title field.

 

2.      Identify any additional descriptors that may be included with the person’s name: Either add it as an alias (e.g. a/k/a John Smith, d/b/a John’s Tree Service) or enter it in the party text field  (e.g. Dr., ward, wife, an individual, etc.), or both when necessary to clarify the complete party name.

John Does

When entering an unknown spouse or unknown heir, use the "LAST NAME" field exactly as you normally would when entering individual names as parties. The "FIRST NAME" field will be used to make the "unknown spouse or unknown heir" designation, and the "MIDDLE NAME" field will contain any first or middle name information available for the known spouse or heir. Note: If no first or middle name information is given for the known spouse or heir, leave the "MIDDLE NAME" field blank.

Money Names (Numerical)

 

When entering money as a party, in the "LAST NAME" field always enter a "$" (dollar sign) first, the amount of money second, and the words "US Currency" or "in United States Currency" last.

Money Names (Spelled Out)

 

When a money party name is spelled out, in the "LAST NAME" field always enter a "$" (dollar sign) first, the amount of money second (always begin with the numerical figures with the amount spelled out in parentheses), followed by the rest of the name, which would usually be "in U.S. Currency" or "in United States Currency."

When entering vehicles as parties, in the "LAST NAME" field, enter the make, model, year and the entire VIN number. Any other identifying information should be added to the "PARTY TEXT" field.
